Welcome to Big Easy Windows. These Terms and Conditions (“Terms”) explain the rules for working with us and for using this website. By requesting a quote, hiring us for a project, or using this site, you agree to these Terms. Please read them carefully and keep a copy for your records.
These Terms are general information and are not legal advice. The specific details of any project, including price, payment schedule, materials, and warranty coverage, are governed by the written estimate or contract you sign with us. Where these Terms and your signed contract differ, your signed contract controls.
1. Who We Are
Big Easy Windows is a window sales, installation, and repair contractor serving New Orleans and the Greater New Orleans area. You can reach us by phone at (504) 384-8165 or through the contact form on this website.
2. Estimates and Quotes
We provide free, no-obligation estimates. An estimate is our good-faith assessment of the work, materials, and price based on the information available at the time of the visit. Quotes are valid for the period stated on the estimate. Prices can change if material costs change, if the scope of work changes, or if conditions found after the estimate require additional work.
An estimate becomes a binding agreement only when you accept it in writing and we both sign a contract or work order.
3. Scope of Work and Change Orders
The work we perform is described in your signed estimate or contract. If you ask for changes, or if we find hidden conditions such as rot, water damage, or structural issues once work begins, we document the change and its cost in a written change order before we continue. We do not perform additional work until you approve the change order.
4. Pricing and Payment
Prices, deposits, and the payment schedule are set out in your written estimate or contract. Unless your contract states otherwise, payments are due as each milestone is reached, and the final balance is due upon completion. We accept the payment methods listed on your invoice. Late or missed payments may pause work and may be subject to fees allowed by law.
5. Scheduling, Access, and Your Property
We will agree on a start window and schedule with you. To keep the project on track, we need safe and clear access to the work areas during the agreed hours. Please move or protect fragile items, valuables, and window treatments near the work area before we arrive. We treat your home with care and clean up the work area when the job is done. For everyone’s safety, we ask that pets and children stay clear of active work zones.
6. Permits, Codes, and Inspections
Some projects require permits or must meet local building codes and wind-load requirements. When permits are part of your project, we will tell you and handle them as described in your contract. You agree to provide any approvals your project needs, such as homeowners association sign-off, before work begins.
7. Products, Materials, and Substitutions
We install the windows and materials specified in your contract. Product appearance, glass, hardware, and finishes can vary slightly from samples and showroom displays. If a specified product becomes unavailable or is discontinued, we will offer a comparable substitute of equal or better quality and confirm it with you before ordering.
8. Warranty
Your project is backed by a workmanship warranty, and the windows we install carry the manufacturer’s product warranty. The length and exact coverage of each warranty are stated in your contract and in the manufacturer’s documentation. Warranties do not cover damage from misuse, accidents, alterations by others, weather beyond a product’s rating, or normal wear. To make a warranty claim, contact us with your project details and we will walk you through the next steps.
9. Your Right to Cancel
If you sign a contract with us at your home, you may have the right to cancel within three business days under applicable federal and Louisiana law. When that right applies to your project, we provide the required cancellation notice with your contract. After the cancellation period, deposits and cancellation terms follow what your contract states.
10. Delays and Events Outside Our Control
We work hard to finish on time. Some delays fall outside our control, including weather, supplier backorders, permit timelines, and the discovery of hidden damage. We are not responsible for delays caused by these events, but we will keep you informed and reschedule as quickly as we reasonably can.
11. Your Responsibilities
- Give us accurate information about your home and your goals for the project.
- Provide safe access to the work areas during scheduled hours.
- Secure or remove valuables and fragile items near the work area.
- Obtain any homeowners association or other approvals your project requires.
- Make payments according to the schedule in your contract.
12. Limitation of Liability
We carry liability insurance and we stand behind our work. To the fullest extent allowed by law, Big Easy Windows is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid for the work related to that claim. Nothing in these Terms limits any rights you have under Louisiana law that cannot be waived.
13. Licensing and Insurance
Big Easy Windows operates as a licensed and insured contractor for the work we perform. We can provide proof of insurance and licensing on request.
14. Project Photos
We may photograph completed work for our portfolio, website, and marketing. These photos show the installed product and the exterior of the work, not personal or identifying details about you. If you prefer that we not use photos of your project, tell us in writing and we will honor your request.
15. Use of This Website
The content on this website, including text, images, and logos, belongs to Big Easy Windows or its licensors. You may view and share it for personal, non-commercial use. Please do not copy, republish, or reuse our content for other purposes without our written permission. We work to keep the information on this site accurate and current, but we do not guarantee that it is free of errors or always up to date.
16. Governing Law and Disputes
These Terms, and any project we perform, are governed by the laws of the State of Louisiana. If a dispute comes up, please contact us first so we can try to resolve it directly. If we cannot reach a resolution, the dispute will be handled in the appropriate courts located in or serving the New Orleans, Louisiana area.
17. Changes to These Terms
We may update these Terms from time to time. The version posted here is the current version, and we will update the date shown at the top of this page when we make changes. Your continued use of this website after an update means you accept the revised Terms.
